Terms of Service

Welcome to Jocus. These Terms of Service (“Terms”) govern your access to and use of the Jocuswebsite, apps, and services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use Jocus
You must be at least 18 years old to create an account. By using the Service you represent that you meet this requirement and that the information you provide is accurate. You are responsible for keeping your login credentials secure and for all activity that happens under your account.
2. Your account and roles
Jocus supports different roles, including performers and producers, and different subscription tiers. You are responsible for choosing the role and tier that fit your use, and for the accuracy of any profile, booking, show, or lineup information you publish.
3. Your content
You retain ownership of the material you create on Jocus, including jokes, setlists, notes, show listings, and profile information (“Your Content”). You grant Jocus a limited, non-exclusive license to host, store, display, and process Your Content solely to operate and improve the Service — for example, showing a show you mark as public in the discovery directory, a press kit you choose to share with producers or list publicly, or delivering a joke or a tape you choose to share for critique.
Material in your joke vault is excluded from the “improve” part of that license. We store it and deliver it to you and to anyone you send it to, and we do not read, review, analyze, or train on it. See the Privacy Policy for how that is enforced.
A recording you upload as a tape is processed — transcribed and measured — because that is the whole point of uploading it, and only ever for you. We do not use tapes to improve the Service, we do not train models on them, and no one at Jocus can open one. Audio is deleted within a day of upload unless you ask us to keep that tape; the transcript and the numbers stay until you delete the tape. Your joke vault is not sent anywhere as part of this, except the single setlist you explicitly ask us to match a tape against.
A tape you hand to another comic is delivered to them as well, for as long as you leave it shared — that being the point of handing it over. Taking it back ends their access, and so does deleting the tape.
If your recording contains other people — another comic’s set, an audience member you talked to, a room that did not know it was being recorded — you are responsible for having the right to record and upload it where you are.
You are solely responsible for Your Content and for having the rights to post it. Do not post content that is unlawful, infringing, or that violates the rights of others.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Harass, threaten, impersonate, or defame other users, performers, or venues.
- Upload malware, attempt to gain unauthorized access, or interfere with the operation or security of the Service.
- Scrape, resell, or misuse listings, contact details, or other data from the Service.
- Send spam or unsolicited communications through invites, submissions, or messaging features.
We may suspend or terminate accounts that violate these Terms or that put other users or the Service at risk.
5. Bookings, invites, and payments between users
Jocus provides tools for producers and performers to connect, invite, book, and coordinate shows. Any agreement to perform, any payment arrangement, and any payout between a producer and a performer is solely between those users. Jocus is not a party to those arrangements and is not responsible for payment, non-payment, cancellations, or the conduct of any user. Payment handles you choose to display (such as Venmo, PayPal, or Cash App) are shared at your discretion.
The same applies between producers. Where you run a show with co-producers, any fee or revenue split you agree is between you and them; the figures Jocus records and reports are a bookkeeping convenience based on what you enter, not a calculation we warrant or a payment we make.
6. Subscriptions and billing
Some features require a paid subscription. Paid plans are billed in advance on a monthly or annual basis through our payment processor, Stripe. Prices are shown before you subscribe.
- Free plan. Creating an account costs nothing and requires no payment method. The free plan is not time-limited and does not convert into a paid plan on its own — you are only charged if you choose to subscribe.
- Referrals. If someone signs up using your referral code and then subscribes, we credit your account with free months once their subscription has been paid for a full month. Credit is applied to your own subscription and has no cash value.
- Renewals. Subscriptions renew automatically at the end of each billing period until canceled.
- Cancellation. You can cancel at any time. Your paid access continues through the end of the current billing period, and you will not be charged for the next period.
- Refunds. Except where required by law, payments are non-refundable.
We may change prices or plan features. If we change the price of a plan you are on, we will give you reasonable notice before the change takes effect.
7. Referrals and promotions
We may offer referral rewards or promotional credits. These have no cash value, cannot be combined unless we say so, and may be modified or discontinued at any time. Abuse of referral or promotional programs (including self-referrals or fake accounts) may result in forfeiture of rewards and account termination.
8. Third-party services
The Service relies on third parties, including Google Firebase (hosting, authentication, and database), Stripe (payments), and Google Maps / Places (venue lookup). Your use of the Service is also subject to those providers’ terms and policies.
9. Intellectual property
The Jocus name, logo, software, and design are owned by Jocus and protected by law. These Terms do not grant you any right to use our branding except as needed to use the Service.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any content or booking arrangement will meet your expectations.
11. Limitation of liability
To the maximum extent permitted by law, Jocus will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
12. Termination
You may stop using the Service at any time, and you can have your account and its content deleted by asking us at support@jocus.app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as content licenses you granted for already-shared material, disclaimers, and limitations of liability) will survive.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
